Having just sustained damage to my car (snapped suspension coil spring) caused by hitting a pothole, I was wondering if anybody else has ever made a sucesssful claim against the Highways Agency? Considering the shocking state of repair of the roads in Lewes, I'm surprised my car has escaped damage before.

It's the tory government and those who voted them in who should cough up.

I broke a wheel years ago near Crawley. The RAC legal line told me exactly what to do. Take a photograph. Get quote for repair ( new wheel in my case). Send to WSCC with covering letter explaining what happened and where and that I hold them responsible and will pursue in small claims court if not satisfied.
A week later I received a cheque from the councils insurers for the full amount with a "with compliments" slip. Easy.

With East Sussex cc you have to prove that they new about the pothole and had not repaired it in their timescale for the type of road and size of hole. ie: large pothole major road = emergency repair within hours, as opposed to large pothole within a residential road maybe a month. All the criteria is on their website.
So if they knew about they hole already when you damaged your car but they were inside the lets say two week window to repair it you haven't got a case in their eyes.

The original message blamed the Highways Agency. Then the discussion turned to County Councils. Who was to blame? We need to know.

The Highways Agency is responsible for motorways and trunk roads (eg A27), the county council for all other roads, except for private roads.
If they don't get round to sorting them out soon, parts of the county will start to look like it's been bombed. Some of the holes are huge.
When we have a cold, snowy winter they blame the weather for the emergence of potholes. Do you think they'll blame the rain this winter?
