Horses by (and sometimes on) Kingston Road

Just had a little run in with a couple of horses (or perhaps racing ponies) on Kingston Road. One of said pair had broken out of a paddock on the corner of Crane Down and Kingston Road, just south of the flyover.
Firstly, is that even a paddock?
Secondly, does anyone know whether they are meant to be there or not?
The link is the location on Google Maps.
Was down there about an hour ago and the escapologee-gee was running about in the road, causing havoc.
Apparently the police have attended and "returned the horses". My concern is that if they've returned them to the same paddock, they may be running around again pretty soon.

Yes it is a proper paddock complete with stables and secure fencing. Or at least it was when I kept my horse there many years ago.
